New KSA fine policy strengthens gambling oversight

Starting from January 1, the Netherlands Gaming Authority (KSA) will implement a new general fine policy with clearer guidelines for imposing fines and offers greater transparency for gambling providers and other supervised entities.

The general fine policy (pdf, 1.2 MB) applies to all violations under the Ksa’s oversight. However, separate penalty policies remain in place for specific areas, such as illegal online offerings and slot machine operations, as these use different penalty systems.

The policy introduces five fine categories, with basic penalties ranging from €500 (category 1) to €2,000,000 (category 5). Category 5 fines are reserved for Wwft violations. For non-Wwft offenses in the highest category (category 4), the Ksa may impose a turnover-based fine of 3% of the offender’s gross revenue, enhancing the fine’s impact.

Michel Groothuizen, the chairman of the board at the KSA, mentioned:

The Ksa is becoming more and more professional as an organization. After the opening of the online market in 2021, we were given a new category of license holders. In 2022, we imposed a first fine on a license holder. We have now gained enough experience to come up with a well-considered fine policy for both permit holders and other parties. That creates clarity for the parties under our supervision and hopefully motivates them all the more to avoid fines.
